Cab driver found guilty for fatal accident

A judge said it was clear that a pedestrian had the right-of-way when he was struck and killed by a cab in downtown Fredericton last year, and he found the cab driver guilty of driving without due care and attention.

Fredericton taxi driver Larry J. McKiel was turning left from York Street onto Brunswick Street at about 11:30 p.m. on April 23, 2008, when his van struck Mark Adams, 25, of Digby, N.S., who was attending university in the city at the time.

Adams was taken to the Dr. Everett Chalmers Regional Hospital and later transferred to the Saint John Regional Hospital with life-threatening head injuries. He later died.

McKiel was charged with driving without due care and attention and stood trial earlier this month.

A police accident reconstructionist told the court that the van was travelling at about 39-42 kilometres per hour when it struck Adams.

Judge Graydon Nicholas said Friday the evidence indicated the left-turn light had turned amber when McKiel made the decision to make a left from York Street onto Brunswick Street.

By the time he proceeded, though, Adams had a green walk light. The impact threw Adams back 14 metres.

"In my opinion, he (Adams) had the right to use the (crosswalk) at that moment," the judge said.

He found McKiel guilty as charged. Sentencing was set over to Aug. 24 to prepare a pre-sentence report and victim-impact statements.

GOOD the cab drivers in fredericton can drive quite insanely. Im glad something was done. I know someone who got hit on his bicycle by a checker cab, and the cab took off by the time the guy could get a number of the car. So the police wouldnt do anything for him because he didn't have that car number. nice huh?

It's a shame that's all he has been charged with....now if they could only stop the way city transit drivers drive the roads would be that much safer...they are far worse than cab drivers

The commentors should not be so willing to put all cab drivers in the same catagory. I'm sure justice will be done, giving the circumstances, in this particular situation, but what about the responsibility of the pedistrian? As a motorist, who has driven the city streets of Fredericton for nearly 50 years. I have never seen such pedistrian dis-respect for vehicle traffic. Do they not realize that these 2000lb cars/trucks can actualls knock them done and perhaps kill them? Did their parents not teach them that they should look both way when crossing the street. I can't believe their parents would encouraged them to "go play in the traffic". Be carefull out there Drivers and Pedistrians alike. (Pedistrians have the right of way) Put that on you Headstone. Think about it.

I believe the law requires that drivers are to expect a person in the stranges palces on the road and to show due regardless of where the person is walking. You are driving a 7 ton missile down the road that kills!

My point is that it is the duty of the sriver to show due care at all times. Not every walker out there is capable of paying attention to cars on the road.
