SIOUX FALLS, S.D. - A South Dakota judge says two men charged with the 1975 slaying of a Canadian woman on the Pine Ridge Indian Reservation can be tried together.
John Graham and Richard Marshall have pleaded not guilty to charges they committed or aided and abetted the first-degree murder of Annie Mae Aquash, a Mi'kmaq from Pictou, N.S. They're scheduled to stand trial in Rapid City, S.D., starting Feb. 24.
Prosecutors accuse Marshall of providing Graham the gun and ammunition he allegedly used to kill Aquash.
Lawyers for both men argued for separate trials. But U.S. Magistrate Judge Veronica Duffy concluded jurors can separate the evidence against each man.
All of those involved were affiliated with the American Indian Movement.
